These website terms of use (the “terms of use”) govern your access to and use of the website. the website is available for your use only on the condition that you agree to the terms of use set forth below. If you do not agree to all of the terms of use, do not access or use the website. by accessing or using the website, you and the entity you are authorized to represent (“you” or “your”) signify your agreement to be bound by the terms of use.
This is a legally binding contract between “you” the “seller of the goods”, Hibyee Software Pvt. Ltd. (“A2z Onlinee”), and + third-party buyers (“buyer”) which provides services for purchasing, recycling and/or donating of used consumer products (the “buyer services”). A2z Onlinee acts as a platform to allow sellers who comply with their policies to sell certain goods. You conduct your actual sales and other transactions directly with the third parties and, unless otherwise specifically and clearly indicated, not with A2z Onlinee. As a result, A2z Onlinee cannot control any aspect of your sales and transactions with third parties, and the third parties are solely responsible to you for all aspects of your sales and transactions with them and consequently A2z Onlinee will have no liabilities towards the sellers or buyers in this regard. in document below “we”, “our”, “us” is used for A2z Onlinee and A2z Onlinee ’s third party buyer collectively.
1. You confirm that you are the legal owner of the item you wish to sell.
2. All initial prices are subject to our appraisal of your device, and no binding offer is issued until we have had the opportunity to evaluate the device. We reserve the right to reject to purchase any item you propose to sell for any reason we deem reasonable in our sole discretion. We have the right to modify our quotation at any time.
3.If you are given an estimate via our website/app/affiliates and we agree to pay you the quoted amount after inspecting your device, you are legally and contractually compelled to sell us the gadget for the price quoted via the website.
4. If you receive a quote through our website/app and upon inspection your device is A) a different model than originally described, B) missing any parts, or C) in a different condition than stated, we, in instances mentioned heretofore and beyond, reserve the right to change our offer.
5. All gadgets sold must be provided with the following documents: a. self-attested ID proof (government approved) of the owner of the old device; b. self-attested indemnity bond given by us if necessary;
6. Only legal sales are permitted. You must possess all legal rights, title, and interest in the gadget or other items you sell us. Your sale and/or shipment of any such goods must not violate any applicable law, regulation, or statute of any jurisdiction. By shipping or selling the picked-up item, you agree not not unlawfully transfer or encumber any intellectual property, trademark, copyright, patent, software, license, or other legal right or limitation. The article you sell must be free of any legal restrictions that would reduce the value of the article or limit your legal right to transfer ownership of the article (including the article itself, any software present on the article, or any hardware on or inside the article). You must not violate any export laws or regulations. The item you offer (including all related materials, software, and add-on hardware) may not be counterfeited, stolen, or include any harmful or offensive information. You agree to indemnify and hold A2z Onlinee, our affiliates, suppliers, licensors, and partners, as well as their officers, directors, employees, agents, and representatives each of them harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party due to or arising out of (i) your access to or use of Services, (ii) your violation of these Terms & Conditions.
7. It is also your obligation to wipe, clean, or delete data from any device being sold via A2z Onlinee. Before handing over the device, you confirm that all data on it will be deleted/erased. You further confirm that, despite manually/electronically wiping the data, if any data is still accessible due to any technical reason, A2z Onlinee or the Third party buyer shall not be responsible for the same, and you will not contact A2z Onlinee for any data retrieval.
8. You realize and accept that once you sell a device through A2z Onlinee, it cannot be returned to you..
9. You understand that products provided as gifts through state-sponsored or non-governmental organization-funded distribution programs will not be accepted on the A2z Onlinee platform.
10.We reserve the right to change this agreement at any moment without prior notice to you. You agree to follow and be bound by the Agreement as modified if you use our website/app, any of our tools, or any of our services after we make an update. Terms and conditions modifying the Agreement take effect immediately after being published.
11. A2z Onlinee reserves the right to cancel/reject any transaction that is deemed suspicious or fraudulent on the organization’s own discretion.
The Services constitute a technology platform that connects users of A2z Onlinee (“Hibyee Software Pvt Ltd) mobile applications or websites provided as part of the Services (each, an “Application”) who are seeking gadget (Phones, tablet, Laptop etc) repair services to a network of third party repair technicians, including, without limitation, independent third party repair technicians and third party logistics providers under agreement with A2z Onlinee (“Third Party Professionals”). The Services are made available solely for your personal/ non-commercial use unless agreed otherwise, in writing in a separate agreement with you.
You acknowledge and accept that A2z Onlinee does not offer device repair services, logistics, or function as a provider of device repair services company. You agree that A2z Onlinee has no responsibility or liability to you regarding any gadget repair services or logistics provided to you by the third party professionals through the use of the services. Our services are to be used by you, if at all, for the purpose of requesting and scheduling gadget repair services or logistics with third party professionals.
A2z Onlinee can not guarantee for the ability, suitability, or safety of third-party professionals. It is entirely up to you to decide whether a third party professional will meet to your demands and expectations. A2z Onlinee will never become involved in disagreements between you and a third party professional . By using the services, you agree that you could come into contact with situations involving third party professionals who are potentially unsafe, offensive, harmful to minors, or otherwise objectionable. You also agree that you use third party professionals anyone with whom you schedule or arrange for using the services at your own risk and judgment. A2z Onlinee shall not have any liability whatsoever arising from or in any way related to your transactions or relationship with third party professionals.
You acknowledge and accept that using the Services may require you to pay payments for the services a Third Party Professional provides to you (the "Charges"). After you have received services, A2z Onlinee will facilitate payment of the applicable Charges on behalf of the Third Party Professional, solely in the capacity of the Third Party Professional's limited payment collection agent, using the preferred payment method you have designated while initiating or modifying your Account. At the end of each session, you will receive receipt in App from A2z Onlinee. By using the Services, you acknowledge and agree that paying the payment of the Charges in this way will be regarded as payment made directly by you to the Third Party Professional(s). Charges will be inclusive of applicable taxes wheresoever required by law. The charges you pay are final and non-refundable, unless A2z Onlinee decides differently at its sole discretion. A2z Onlinee will respond accordingly to any requests from a Third Party Professional to modify the Charges for a specific service, even though you do have the right to request lower Charges from a Third Party Professional at the time you receive such services from the Third Party Professional.
You acknowledge and accept that (i) all Charges are payable immediately, and (ii) A2z Onlinee will facilitate payment by utilizing the preferred payment method you choose while initiating or modifying your Account. If your primary account payment method is determined to not able to be charged for any reason whatsoever, you agree that A2z Onlinee may, as the Third Party Professional’s limited payment collection agent, use a secondary payment method in your account, if available.
A2z Onlinee maintains the right, in its sole discretion, to set, remove, and/or modify fees for any or all components of the Services at any time. A2z Onlinee will make a fair attempt to let you know about potential charges, but you are still accountable for them regardless of whether you are aware of them or their amounts thereof. We may from time to time make promotional offers and discounts available to certain users, which may result in different charges for the same or similar services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the services or the charges applied to you. You may cancel your request for services from a Third Party Professional at any time prior to the arrival of such Third Party Professional.
1. We do not necessarily use original/genuine Apple parts to repair the phone.
2. Please keep in mind that repairing your phone through A2z Onlinee will terminate/void your Apple warranty.
The Third Party Professional provides a minimum 30 day warranty (more than 30 days if specified in order) on the gadget repair services as follows: (a) screen/LCD and/or any other repaired or replaced parts that malfunction or do not work as intended or designed to work, and (b) the warranty provided is limited to the parts and/or service(s) that you paid for. Except as otherwise stated in these Terms, the warranty covers the labor cost of part replacement as well as any additional repairs expressly arising from the initial repair.
The above-mentioned warranty does not cover: (a) Your activities that result in damage to the device that the third-party professional repaired;
(b) Problems with software unrelated to the repair
(c) Devices that have been jailbroken
(d) Any loss of data occurring as a result of the repair (YOU ARE ADVISED TO BACK UP ALL DATA PRIOR TO ANY REPAIR ATTEMPT)
(e) Any problem/issue with the device that you were aware of, advised to the Third Party Professional or A2z Onlinee, and noted before the repair was completed
(f) Water damage
The warranty set forth in these Terms applies exclusively to the repaired devices and the original customer. Under no circumstances the warranty will not be transferred to other devices or to any individual other than you.
While you are responsible for notifying A2z Onlinee of any warranty claims, and A2z Onlinee will then inform the Third Party Professional of the need to investigate the warranty claim, it is the Third Party Professional who actually performed the repair service who will be solely responsible for carrying out the warranty repair services. You grant the Third Party Professional permission to repair your mobile phone, tablet, or any other product by utilizing the Services. You are aware that neither A2z Onlinee nor the Third Party Professionals are Authorized Service Providers (ASP) of any manufacturer of mobile phones or tablets, including but not limited to Apple Inc., and that neither A2z Onlinee nor the Third Party Professional are in any way affiliated to the manufacturer of the gadget, including but not limited to Apple Inc. Furthermore, you acknowledge that by using the Services, you release, indemnify, and hold A2z Onlinee harmless from any claims or damages of any kind or description that may result from any gadget device repair work carried out on your device, unless such claim is due to the Third Party Professional's gross negligence.
By using the Services, you agree that A2z Onlinee is not responsible for any data loss that may arise from work performed on your device. You are aware that before permitting the Third Party Professional to repair on your device, you have the option to back up your device and are responsible for backing up your device.
By using the Services, you agree that any technical support or repairs provided by a Third Party Professional may void any manufacturer warranties for the device being repaired and that A2z Onlinee will not be held responsible for liability or warranty in the event that the manufacturer warranties stand abated. No responsibility is assumed by A2z Onlinee or the Third Party Professionals for any indirect or consequential damages arising from a repair or repair attempt, including any lost or damaged data, software, or the customer lost profits or revenue.
Each part and accessory provided to you as a component of the repair performed by the Third Party Professional under these Terms will be materially free of manufacturing defects from the date the repair Services are provided to you for a minimum of 30 days, so long as you remain the owner ("Warranty Period"). A2z Onlinee’ sole obligation, and your sole remedy, under this warranty is limited to, at A2z Onlinee’ sole discretion, repair or replacement of the defective part or accessory provided as a component of the repair. This warranty is non-transferable under these Terms.
Please keep in mind that A2z Onlinee's obligations under the warranty contained in these Terms are conditioned on your prompt notification to both the Third Party Professional and A2z Onlinee of any warranty claim and following A2z Onlinee's then-current warranty procedures provided to you.
The limitations and exclusions in this section may not apply to you because some jurisdictions do not allow limitations on implied warranties. Your statutory rights that cannot be waived, if any, are not affected by these provisions.You accept and agree that the liability and warranty limits and exclusions provided in these terms of use are fair and reasonable.
